Becky is a middle school student in West Virginia. She has been a cheerleader and wants the opportunity to try out for the cross-country team. A new law in West Virginia would ban her from doing so because she is transgender. Becky and her parents sued and are represented by the ÀÏ°ÄÃÅ¿ª½±½á¹û, the ÀÏ°ÄÃÅ¿ª½±½á¹û of West Virginia, Lambda Legal and Cooley LLP.

Hersom v. Crouch
Xavier Hersom applied for and was denied a gender marker change on his birth certificate. He said DHHR’s policy has created yet another layer of difficulty for him as a transgender person living in West Virginia. The ÀÏ°ÄÃÅ¿ª½±½á¹û, the ÀÏ°ÄÃÅ¿ª½±½á¹û of West Virginia, and the Harvard Law School LGBTQ+ Advocacy Clinic filed a federal lawsuit asking a court to declare West Virginia’s birth certificate policies relating to transgender people unconstitutional on behalf of Hersom and an another anonymous plaintiff.
