Trump鈥檚 Lawyers Say the Muslim Ban Has No Bias, But His Tweets Show Otherwise

Yesterday morning, President Trump shared three videos on Twitter that purport to show Muslims committing graphic acts of violence. He retweeted all three from the account of , deputy leader of the ultranationalist party Britain First, who was convicted of religious aggravated harassment in November 2016 after abusing a woman wearing a hijab. The president鈥檚 move prompted public outcry and from Prime Minister Theresa May, whose spokesman underlined that Britain First is a source of 鈥渉ateful narratives which peddle lies and stoke tensions.鈥

We should all be outraged that the president of the United States is promoting and endorsing videos that are plainly designed to fan the flames of anti-Muslim hatred. The decision to do that is reckless, dangerous, and contrary to fundamental American values that protect all of us from religious discrimination. It is not, however, surprising.

Trump's prejudice against Muslims reveals itself at every turn 鈥 because he is the one revealing it. He showed his bias with Wednesday鈥檚 tweets, with like "Islam hates us,鈥 and with every version of the Muslim ban, the latest of which the 老澳门开奖结果 and partners will challenge in the Fourth Circuit Court of Appeals on Dec. 8.

Not surprisingly, courts have repeatedly recognized that the president鈥檚 Muslim bans are inextricably tied to the president鈥檚 flagrant prejudice and his repeated promises to ban Muslims from coming to the United States. When the Fourth Circuit struck down the second version of the Muslim ban, Judge James Wynn , 鈥渓aid bare, this Executive Order is no more than what the president promised before and after his election: naked invidious discrimination against Muslims.鈥 Judge Wynn 鈥渢hat even when the president invokes national security as a justification for a policy that encroaches on fundamental rights, our courts must not turn a blind eye to statements by the president and his advisors bearing on the policy鈥檚 purpose and constitutionality.鈥

The federal government, however, has argued that the third version of the Muslim ban should be considered in a vacuum 鈥 divorced from its history, context, and previous court rulings, in large part because certain agencies carried out before the president issued it. But that process does not wipe away history, as the Maryland district court found when it blocked the third version as 鈥渢he inextricable re-animation of the twice-enjoined Muslim ban.鈥

Yesterday鈥檚 tweets can be added to Trump鈥檚 long list of anti-Muslim statements and actions, including:

  • when an MSNBC reporter asked Donald Trump if he thinks Islam is an inherently violent religion, Trump answered, 鈥淲ell, all I can say 鈥 there鈥檚 something going on. You know, there's something definitely going on. I don't know that that question can be answered,鈥 He concluded, 鈥淲e are not loved by many Muslims.鈥
  • , at a campaign rally in South Carolina, Trump read a statement, 鈥渃alling for a total and complete shutdown of Muslims entering the United States until our country鈥檚 representatives can figure out what is going on.鈥
  • , Trump told a CNN reporter that 鈥淚 think Islam hates us. There鈥檚 something there that 鈥 there鈥檚 a tremendous hatred there. There鈥檚 a tremendous hatred. We have to get to the bottom of it. There鈥檚 an unbelievable hatred of us.鈥
  • , Trump defended his proposal for a Muslim ban, saying 鈥淧eople were so upset when I used the word Muslim. 鈥極h, you can鈥檛 use the word Muslim. Remember this. And I'm okay with that, because I'm talking territory instead of Muslim.鈥
  • , after a terrorist attack took place in Barcelona, Trump told his Twitter followers to 鈥渟tudy what Gen. Pershing of the United States did to terrorists when caught. There was no more Radical Islamic Terror for 35 years.鈥 He was referring to a story of Pershing shooting Muslim insurgents in the Philippines with bullets dipped in pigs鈥 blood.

And yesterday, he amplified Fransen, whose videos are enthusiastically titled: 鈥淚slamist mob pushes teenage boy off roof and beats him to death!鈥; 鈥淢uslim Destroys a Statue of Virgin Mary!鈥; and 鈥淢uslim migrant beats up Dutch boy on crutches!鈥

Following from allies, from the Netherlands Embassy, and from David Duke, his administration doubled down. Press Secretary Sarah Sanders said, 鈥渨hether it is a real video, the threat is real.鈥

As has been clear for quite some time, Donald Trump is targeting Muslims. And despite his lawyers鈥 attempts to recast the Muslim ban, he simply cannot stop revealing it for what it is 鈥 an unconstitutional attempt to turn his bigotry into law. Next week, the president鈥檚 lawyers will again be in court arguing that the Muslim ban has nothing to do with banning Muslims. It鈥檚 too bad for them that the president keeps revealing the opposite.
