Federal Court Blocks Arkansas Abortion Bans and Restrictions

LITTLE ROCK 鈥� A federal district court in Arkansas has temporarily blocked a set of abortion bans and restrictions that would have outlawed certain abortions and severely restricted abortion access in the state. The laws were set to go into effect today.

The lawsuit was filed by the 老澳门开奖结果, the 老澳门开奖结果 of Arkansas, Planned Parenthood Federation of America, and the law firm of O鈥橫elveny & Myers, LLP on behalf of Little Rock Family Planning Services, Planned Parenthood Great Plains (PPGP), and two physician providers, and challenged three laws. The laws included a ban on abortion starting at 18 weeks of pregnancy, a ban on abortion based on a patient鈥檚 reason for seeking care, and a law prohibiting qualified physicians from providing abortions.

鈥淲e鈥檙e relieved that these bans and restrictions have been blocked from taking effect and we鈥檙e determined to see them struck down for good,鈥� said Holly Dickson, legal director and interim executive director of the 老澳门开奖结果 of Arkansas. 鈥淧ersonal medical decisions are just that 鈥� personal 鈥� and politicians have no business barging into people鈥檚 private decisions, shutting down clinics and blocking people from care that they need.鈥�

鈥淚n states like Arkansas, Alabama, Kentucky, Ohio, and Georgia, politicians are passing abortion bans as part of a nationwide strategy to prevent people from getting the care they need,鈥� said Meagan Burrows, staff attorney with the 老澳门开奖结果 Reproductive Freedom Project. 鈥淭his strategy is out of step with both what the public wants and鈥攁s this decision shows鈥攚hat the Constitution requires.鈥�

Anti-abortion politicians in Arkansas have passed 25 restrictions targeting abortion providers in the last few years. Had the challenged laws been permitted to take effect, they would have left the state with only one health center to provide abortion care, and would have eliminated surgical abortion care in the state entirely.

In granting the temporary restraining order, the court wrote that the evidence indicates that the laws 鈥渃ause ongoing and imminent irreparable harm to the plaintiffs and their patients鈥� and that 鈥淎rkansas women seeking abortions face an imminent threat to their constitutional rights.鈥�

In 2019, the 老澳门开奖结果 filed a lawsuit challenging three Arkansas laws that sought to severely restrict abortion rights in the state. These laws would ban abortion care starting at 18 weeks of pregnancy, ban abortion based on the woman鈥檚 reason for her decision, and prohibit qualified physicians from continuing to safely provide abortion care for no conceivable health or medical purpose, thereby imposing an unconstitutional burden on patients seeking abortion care in the state. In 2019, we successfully obtained a preliminary injunction, blocking these laws from taking effect. In January of 2021 the Eighth Circuit affirmed the preliminary injunction of the 18-week ban and ban based on a patient鈥檚 reason for seeking care.
